The Purchaser is deemed to have accepted the terms and conditions listed below. Progear
reserves the right to amend the terms and conditions set out at any time.

1. Progear will deliver the items on the order form specified by the purchaser,
it fully reserves the right to deliver a similar product for reasons beyond its
control, any such action shall not be deemed as poor delivery.

2. Progear will deliver the Product ordered through us in new condition.
|
3. Progear will process the order immediately upon receipt. Please allow 1-2 days
for secure delivery.
|
4. Progear will take every care to ensure the goods are delivered to the intended
recipient. Progear cannot be held responsible for any wrong delivery of the product
where an incorrect address has been provided by the purchaser or if any persons
falsely claim to be the intended recipient and takes delivery of goods. In the case
of delivery failure due to incorrect address, refusal to accept or recipient not
at home, the purchaser will be charged for the order and any subsequent reshipping
costs.

5. All prices and availability of products are subject to change without prior notice
by professionalgear.net

6. Progear reserves the right to cancel all orders resulting from incorrect information
mistakenly displayed on the website. This is regardless of whether the order has
been confirmed or payment being accepted via credit card. In the event the payment
has been processed by professionalgear.net the same amount will be credited to the
credit card account and the purchaser notified.

7. Progear will not be liable for any credit card fraud. The liability to use a
card fraudulently will be on the user and the onus to 'prove otherwise' shall be
exclusively on the user.

8. Items will only be taken back due a manufacturing failure (12 months manufacturer’s
warranty); deliberate or accidental damaged goods will not be accepted. In the case
of all returned items the purchaser must bear the cost of shipping and packaging.
The original purchase shipping costs will not be refunded. Items under warranty
will be replaced or repaired within 7 to 10 days of receipt at our Pro Gear offices.

9. All cancellations must be made within 24hrs of purchase by email to info@professionalgear.net.
Cancelled items must have original packaging and be in the same condition as they
were dispatched. A fee of 10% will be applicable for all cancelled goods returned
in an open box condition. A refund will be issued within 7 days of the items arriving
at the Professional gear offices.

10. Progear is under no obligation to support product warranties, all warranties
or after sale services offered by the manufacturer on any product shall be serviced
directly by such manufacturer and Progear shall not be under any obligation to ensure
compliance or handle complaints.

11. The UK courts will have exclusive jurisdiction in any proceedings arising out
of this agreement.
